H.R. 5557 – To amend the Public Health Service Act…

As of September 26, 2025 this bill has no published text. While this is not uncommon for Bills presented to Congress, I find it to be kind of ridiculous that our Legislators would entertain putting something on the docket that basically does not actually exist. However, moving on from that, Madam Congresswoman Salinas has presented the following “representative” explanatory text.

To amend the Public Health Service Act to revise and extend projects relating to children and to provide access to school-based comprehensive mental health programs.

This Bill appears to presume to direct the activities and directions of an Executive Agency. Of course, it is just “amending” previous Congressional Direction to an Executive agency, however, the fact that previous direction was given does not justify this direction, nor the original direction.

Article I, Section 8 of The Constitution grants Congress 17 specific powers. None of which are to create Federal Agencies, nor to dictate the activities, or scope, of Executive Branch Agencies.

To clarify any questions regarding Congress’ powers, and in fact the powers of the Federal Government as a whole the 10th Amendment to the Constitution was created. It clearly states, “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

This Bill, and the “Public Health Service Act” it amends clearly appear to be an overreach of Congressional power.
